INTERNAL DISCIPLINARY RELATED MATTERS
We assist employees and companies inter alia with advice and guidance as to how to handle disciplinary enquiries and deal with charges levelled against them. We represent companies and employees at disciplinary enquiries subject to agreement with the company and/or on application to the chairperson of the enquiry. We further assist with the drafting of appeal documents, should the company have an appeal process.
We represent both individual and corporate clients in arbitrations in various forums around the country. Our services include but are not limited to the drafting and/or argument of a variety of matters and applications including inter alia jurisdictional disputes, condonation applications, rescission applications and legal representation. In addition to the above, where legal representation is not permitted, we can assist with the preparation of the case and provide advice on how to oppose or present the case.
LABOUR COURT AND/OR HIGH COURT LITIGATION
We regularly assist clients in instituting or opposing various applications and trial proceedings. This includes matters pertaining to inter alia sexual harassment, automatic unfair dismissals, discrimination, industrial action, exception proceedings, review applications and urgent applications.
We further provide sound advice in relation to contractual related matters originating from the employment relationship, including matters related to restraint of trades, unpaid bonuses, restraint payments and damages suffered due to breach of contract.
